Terms of Service

These Terms of Service set out the rules that apply to access to and use of Jovena, a lightweight botanical lifestyle community app centered on plant identification, specimen logging, and sharing nature-inspired ideas. They are intended to explain the legal relationship between you and the operator of the application in clear, direct language.

1. Acceptance of Terms

Accessing Jovena, creating an account, browsing content, or otherwise interacting with the platform indicates that you accept this agreement as a binding set of conditions for your use of the application.

Anyone who is not willing to proceed under these Terms should discontinue access and remove the application from their device. Your decision to use the platform carries legal significance, and these provisions apply from the moment use begins.

2. Service Description

Jovena offers a digital environment related to botanical lifestyle interests, including community-oriented tools, informational experiences, and user participation features connected to plant-focused content and inspiration.

The platform may evolve over time. Functions may be added, adjusted, limited, interrupted, or retired without creating an obligation to preserve any particular feature set. Availability is not promised on a permanent, uninterrupted, or error-free basis.

3. User Responsibilities & Conduct

Use of the application is limited to individuals who are at least 18 years old. By accessing Jovena, you confirm that you meet this minimum age requirement.

All users are expected to act responsibly and lawfully. The following conduct is prohibited:

  • using the platform for unlawful, deceptive, or harmful purposes;
  • harassing, threatening, abusing, or targeting other users or third parties;
  • uploading malware, malicious code, or material intended to disrupt systems or security;
  • attempting unauthorized access to accounts, data, servers, or connected networks;
  • impersonating another person or misrepresenting your affiliation or identity.

You are responsible for activity occurring under your account or device access. A breach of these standards may lead to content removal, suspension, permanent loss of access, or additional action where appropriate.

4. Intellectual Property

Jovena, including its software, design elements, text, branding, visual layout, and related materials, remains the property of its developer or applicable licensors and is protected by intellectual property laws.

Users receive a limited, revocable, non-exclusive, non-transferable permission to access the application for personal, lawful use only. Except where applicable law expressly permits otherwise, you may not copy, reproduce, adapt, distribute, decompile, reverse engineer, or create derivative works from any portion of the application.

5. Disclaimer

Jovena is made available on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent allowed under applicable law, the application is provided without guarantees of any kind, whether express, implied, or statutory.

This includes, without limitation, disclaimers relating to merchantability, fitness for a particular purpose, title, non-infringement, reliability, availability, accuracy, or security. Information, tools, and interactions available through the platform are used at your own discretion and risk.

6. Limitation of Liability

To the maximum extent permitted by law, the developer, operator, affiliates, licensors, and service providers connected with Jovena will not be responsible for direct, indirect, incidental, special, punitive, or consequential losses arising out of or related to your access to, inability to access, or use of the application.

This limitation applies even if a possible loss was foreseeable or had been brought to our attention. Covered losses include, among other things, loss of revenue, loss of profits, data loss, device issues, service interruption, corruption of files, and disruption to business or personal activities.

7. Account Termination

Access to Jovena may be restricted, suspended, or ended at our discretion if conduct appears inconsistent with these Terms, creates risk for the platform or its users, or is otherwise inappropriate. Action may be taken immediately and without advance notice where circumstances warrant.

You may also stop using the application at any time. Ending use of the platform does not automatically erase obligations or rights that arose before access ended.

8. Terms Modification

From time to time, these Terms may be revised to reflect operational, legal, technical, or business changes. When updates are published, the revised version becomes the governing version from its stated effective date.

Ongoing use of Jovena after updated Terms take effect signals your acceptance of the revised conditions. For that reason, you should review this page periodically.

9. Governing Law

These Terms are governed by the laws of the applicable jurisdiction in which the service operator is established, without regard to conflict-of-law principles that would require application of another legal system.

Any dispute, claim, or controversy connected to Jovena or these Terms should first be raised through good-faith communication with us. If a matter cannot be resolved informally, it shall be handled in the courts or other legally recognized dispute-resolution forum having proper authority in that jurisdiction, unless mandatory law requires a different process.
